General terms and conditions
Article 1. Definitions
1.1 In these terms and conditions, the following terms are used with the meanings given below:
Customer: any natural person or legal entity that enters into an agreement with Eponim for the purchase of animal products.
Product: all animal products offered by Eponium.
Agreement: any agreement between Eponium and the customer relating to the sale of products.
Article 2. Applicability
2.1 These General Terms and Conditions apply to all offers, orders, deliveries and agreements of Eponium, unless otherwise agreed in writing.
2.2 By placing an order, the customer agrees to these general terms and conditions.
Article 3. Product information and use
3.1 The products are intended for use on animals only and must not be used for other purposes.
3.2 Use of the products is at the customer's own risk. Please consult a veterinarian when in doubt about the use or suitability of an animal product for a specific animal.
Article 4. Ordering and delivery
4.1 Orders can be placed through the webshop, by phone or by email. 4.2 Eponium aims to process and dispatch orders within 3 to 5 working days. Exceeding the delivery time does not give the right to compensation or cancellation of the order.
4.3 Shipping costs will be charged separately unless otherwise stated or agreed.
Article 5. Payment
5.1 Payment must be made by one of the methods indicated during the ordering process.
5.2 The customer is obliged to pay the amount due within the specified period. In case of late payment, Eponium reserves the right to cancel the order.
Article 6. Returns and right of withdrawal
6.1 The customer has the right to withdraw from the agreement without giving reasons within 14 days of receiving the product.
6.2 The customer must return the product in its original, unopened and undamaged packaging. Opened or used products cannot be returned.
6.3 Return costs shall be borne by the customer unless otherwise agreed.
Article 7. Warranty and liability
7.1 Eponium guarantees that the products comply with the agreement and the specifications as stated on the website.
7.2 If the product delivered is defective, the customer must notify Eponium in writing within 14 days of delivery. Eponium will, at its discretion, replace the product or refund the purchase price.
7.3 Eponium is not liable for damage caused by improper use of the products, nor for indirect damage such as consequential damage, loss of income or damage to third parties.
Article 8. Force majeure
8.1 Eponium is not liable for delays in delivery or non-performance of the agreement if this is due to force majeure. Force majeure includes, inter alia, natural disasters, wars, strikes, pandemics and power failures.
Article 9. Privacy and data protection
9.1 Eponium processes personal data of customers only in accordance with its Privacy Policy, which is in line with the General Data Protection Regulation (GDPR).
9.2 The customer has the right to request access to his/her personal data or to have them corrected or deleted at any time.
Article 10. Applicable law and dispute resolution
10.1 These general terms and conditions and the agreement are governed exclusively by Dutch law.
10.2 Disputes arising from the agreement or these terms and conditions will in the first instance be submitted to the competent court in the district where Eponium has its registered office, unless mandatory law requires otherwise.
